Unfortunate Legal Action
I regret that I have had to take part of the income earned as a result of the
copyright of "Little Did She Know" to hire an attorney to write a cease and
desist letter to K. Foley/link4u.com as she continued to violate copyright law
regarding the composition of the song, “Little Did She Know”. Needless to say,
as I've committed to donating half the net proceeds to 9/11 charities which to
date has raised over $26,000, this is an unfortunate business expense I did not
anticipate and am forced to incur and will indeed impact the amount that I am
able to donate to charities.
K. Foley/Link4u made initial contact with me after hearing my recording on the
radio and requested permission to make a video tribute to accompany my recording
of "Little Did She Know" and have it available on her website for free online
viewing only in the fall of 2001. We granted them permission for that use as we
did to many. However, she began selling my recording and profiting from it
without my knowledge that I didn’t authorize, license or endorse and continued
to profit from it by taking liberties with the song ….all in copyright violation
and continued to violate copyright law even after she was informed and
repeatedly asked to comply. Though our legal remedy has prevented her from
selling the original recording of the song, she can still legally distribute her
video and has now caused another singer to legally license the song (who's
version Ms. Foley now sells at her website and who she incidentally now books
for performances) so she may continue to profit from the composition of "Little
Did She Know". Sadly in her continued efforts promoting her video, Ms. Foley
makes no mention of the songwriter in the credits of the video and the fact that
if it had not been for the original recording, her video would not exist at all.
I have come to realize that although I felt this song was a gift and a way to
help and raise money for the people who were most affected by this national
tragedy and took a permanent leave of absence from a teaching position so I
could be available to perform this song free of charge.....sadly, for others it
is business as usual :(
Out of all of the songwriters in the world God could have given this song to,
for whatever reason, He gave it to me and I take that responsibility very
seriously and will continue to protect its integrity.
